1. About these terms

1. About these terms

These terms govern your use of Whispers, a meeting intelligence service operated by Human Meetings Ltd ("we", "us", "Whispers"). By creating an account or using the service, you agree to these terms. If you are using Whispers on behalf of a business or organisation, you confirm you have authority to bind that entity.

Whispers is intended for professional use by adults. It is not designed for personal, domestic, or consumer use, and it is not suitable for anyone under the age of 18.

2. Your account

2. Your account

You are responsible for keeping your login credentials secure and for all activity that takes place under your account. Notify us immediately at hello@whispers.tech if you suspect unauthorised access.

You may not share your account with others or create multiple accounts to circumvent usage limits or billing.

3. The service

Whispers provides tools to capture and analyse discussions, generate transcripts, and produce AI-powered session intelligence. The service is provided via mobile and desktop applications.

  • AI-generated content.
All analyses, summaries, scores, and recommendations produced by Whispers are generated by artificial intelligence and are provided for informational purposes only. They do not constitute professional advice of any kind — legal, financial, medical, or otherwise — and should not be relied upon as such. You are responsible for exercising your own judgement when acting on any analysis produced by the service.

  • Service availability.
We aim to keep Whispers available at all times but do not guarantee uninterrupted access. We may carry out maintenance, updates, or changes to the service at any time. We will endeavour to notify users of significant planned downtime in advance.

4. Sessions and consent

4. Sessions and consent

  • Your legal responsibility.
Capturing audio of a conversation may be regulated by law in your jurisdiction and in the jurisdictions of your participants. You are solely responsible for ensuring that your use of Whispers complies with all applicable laws regarding consent to capture, data protection, and privacy — including but not limited to UK GDPR, EU GDPR, and any local recording laws that apply to you or your participants.

  • Informing participants.
Before starting any session, you must ensure that all participants are aware that the discussion is being captured and that the session audio will be processed to generate a transcript and analysis. You must not use Whispers to capture any person without their knowledge.

  • Professional obligations.
If you are subject to professional conduct rules or ethical standards that govern how you handle client information or session data — such as those of the International Coaching Federation, a bar association, a medical regulator, or any similar body — you are responsible for ensuring your use of Whispers complies with those obligations. Whispers does not verify compliance with any such standards.

  • Indemnity.
You agree to indemnify and hold harmless Human Meetings Ltd against any claims, losses, or liabilities arising from your failure to obtain appropriate consent or comply with applicable recording laws.

5. Acceptable use

5. Acceptable use

You may use Whispers only for lawful purposes and in accordance with these terms. You must not:

  • Capture any session without the knowledge of its participants.

  • Use the service to capture any person under the age of 18.

  • Use the service to process classified, legally privileged, or regulated information where doing so would violate applicable law or professional rules.

  • Attempt to reverse-engineer, copy, or reproduce any part of the Whispers software or analysis methodology.

  • Use the service in any way that could damage, disable, or impair its operation or interfere with other users.

  • Resell, sublicense, or otherwise make the service available to third parties without our prior written consent.

6. Credit and billing

6. Credit and billing

  • How billing works.
Whispers operates on a prepaid credit model. You purchase credit in advance, which is deducted from your balance at a rate of £1.00 per hour of session audio (pro-rated to the nearest second). New accounts receive £5.00 of free credit on registration.

  • Purchasing credit.
Credit is purchased via the in-app top-up flow, processed by Stripe. All prices are in GBP and inclusive of any applicable VAT.

  • Low balance.
If your balance reaches zero, you will not be able to start new sessions until you top up. Sessions in progress when a balance reaches zero will continue and may result in a small negative balance, which must be cleared before further sessions can be started.

  • Refunds on unused credit.
Credit top-ups are non-refundable. Unused credit has no cash value and will not be reimbursed on account closure or cancellation.

7. Cancellation and account closure

7. Cancellation and account closure

You may close your account at any time by contacting hello@whispers.tech or via the account management screen in the app.

On account closure, all personal data associated with your account — including sessions, transcripts, and analyses — is permanently deleted. This deletion is irreversible. We strongly recommend exporting your session data before closing your account (see the export feature in the app).

Anonymised, aggregated patterns that do not identify you or any session participant may be retained as described in our Privacy Policy.

8. Deletion and data loss

8. Deletion and data loss

Deleting a session in Whispers is a permanent, immediate hard delete. There is no recovery mechanism and no backup from which deleted data can be restored. Human Meetings Ltd accepts no liability for loss of data resulting from deletions made by you or at your request.

9. Intellectual property

9. Intellectual property

  • The Whispers service.
All software, algorithms, analysis methodology, design, and branding comprising the Whispers service are owned by or licensed to Human Meetings Ltd. Nothing in these terms grants you any rights in the Whispers software or intellectual property beyond the right to use the service as described here.

  • Your content.
You retain ownership of all session audio, transcripts, and analysis outputs generated from your sessions. By using the service, you grant Human Meetings Ltd a limited licence to process your content solely for the purpose of providing the service to you. We do not claim any ownership of your content.

10. Limitation of liability

10. Limitation of liability

To the fullest extent permitted by law, Human Meetings Ltd shall not be liable for:

  • Any loss of data, including session audio, transcripts, or analyses, whether arising from deletion, technical failure, or any other cause.

  • Any reliance placed on AI-generated analysis, summaries, scores, or recommendations produced by the service.

  • Any indirect, consequential, or special loss arising from your use of the service.

  • Any failure to comply with recording laws or professional obligations in your jurisdiction.

To the extent that any direct liability cannot be excluded, Human Meetings Ltd's total liability to you in respect of any claim shall not exceed the total amount paid by you for the service in the twelve months immediately preceding the date of the claim.

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded.

11. Changes to these terms

11. Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you by email or via an in-app notice at least 14 days before the changes take effect. Continued use of the service after that date constitutes acceptance of the updated terms. If you do not accept the changes, you may close your account before they take effect.

12. Termination

12. Termination

We may suspend or terminate your account if you breach these terms, if your balance remains negative for an extended period, or if we have reasonable grounds to believe your use of the service is unlawful. We will endeavour to give notice before termination unless the circumstances require immediate action.

On termination for breach, no refund of unused credit will be due.

13. Governing law

13. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
